Terms & Conditions
1.0 Agreement
​
1.1 All swimming lessons and instructions by MLKY Holdings Sdn. Bhd. (hereinafter referred to as “Blu Swim School”) shall be provided subject to the terms and conditions set out herein.
​
1.2 By signing the Release of Liability (Waiver) Form on your first lesson, you are deemed to represent to Blu Swim School that you have full legal capacity to execute this Agreement whether for yourself or on behalf of your child/ward; and that you have read, understood and accepted the terms and conditions set out herein.

2.0 Registration, Fees and Payment
​
2.1 The swimming lessons will only be confirmed, upon the agreed terms and conditions, completion of registration form and payment submission.
​
2.2 The pre-agreed time slot will be opened to other students, if there is no confirmation (registration and payment submitted) on the swimming classes as the time slot is on a first come first serve basis.
​
2.3 All fees must be paid in full by the stipulated date and before the student starts the first lesson. Partial payments or any deposit will not be accepted.
​
2.4 Fees paid are not refundable should the student fail to attend or withdraw from the lesson registered. Fees paid are not transferable or refundable if the student decides to sign up for another lesson type.
​
2.5 Students are not allowed to transfer any remainder or balance lessons to other persons or to other lesson types.
​
3.0 General Lesson & Class Freeze Policy
​
3.1 Blu Swim School shall have full discretion to assign any instructors it deems fit to conduct any classes.
​
3.2 Students wishing to renew their existing lessons must inform Blu Swim School of their intention to do so and to pay the relevant fees in full, seven (7) days prior to the last class of their existing lessons in order to secure their existing time slot for their lessons.
​
3.3 Blu Swim School does not guarantee the ability of any student to successfully learn swimming if the student does not follow the instruction given by Blu Swim School’s instructors and/or the student has inconsistent attendance.
​
3.4 Parents accompanying students for lessons should not pass comments of or to students when lessons are on-going to avoid distracting their focus.
​
3.5 If the pool is closed for any reason or temporarily closed due to water safety, students shall be given extra replacement week(s) and the expiry of the original validity period shall be extended in correspondence to the pool closed period. This only applies if the pool is closed before the lesson commences or within the first 10 minutes after the lesson has started.
​
3.6 Students are not allowed to put on hold or freeze any lesson outside of the conditions stated in the Class Freeze Policy herein. Students wishing to do so on medical grounds must submit to Blu Swim School a written request with a medical report issued by hospitals or doctors confirming that the student concerned is not fit to swim for an extended period of time. Blu Swim School is not obligated to approve the request and shall have full discretion to approve or reject the request.

3.7 Class Freeze is only applicable for one (1) time, per package purchased (only applicable to 3 months’ and 6 months’ packages), NO additional Class Freeze is provided thereafter. The pre-agreed time slot will be opened to other students.
​
3.8 Class Freeze is not applicable to Private Classes, Private Group Classes and 1 month package Group Classes.
​
3.9 Subject to Clause 3.7, Class Freeze is only applicable when there is at least four (4) weeks before the date of expiry of the existing package purchased. The validity period of the existing package purchased shall be extended in correspondence to the duration of class freeze.
​
3.10 Students who choose to exercise this policy must freeze their existing lesson balance for a minimum two (2) weeks to a maximum of four (4) weeks freeze duration. The freeze period has to be consecutive weeks.
​
3.11 After the Class Freeze period is utilised completely, students are to attend their lesson on the stipulated period. Failure to do so will result in their class being forfeited and their lesson credit will be deducted.
​
4.0 Class Cancellation & Replacement
​
4.1 Students who are unable to attend their lesson for any reason including any medical reasons shall inform Blu Swim School no later than one (1) hour before the scheduled lesson commences. In such event, the student shall be allowed for replacement of classes, subject to the availability of time slot and schedule of Blu Swim School.
​
4.2 The class shall be forfeited and lesson credit will be deducted for students who failed to inform Blu Swim School of his/her absence within the time frame stipulated above.
​
4.3 Generally, replacement of class is applicable to all packages purchased, subject to the availability of time slot and schedule of Blu Swim School.
​
5.0 Group Classes and Private Classes
​
A. Children Group Classes for Age 4 to 12 (45 minutes per class)
​
i. Children Group Classes for Age 4 to 12 are on credit basis, subject to each package purchased.
​
ii. Package Validity:


iii. Students are generally grouped according to their respective age, swim levels and learning progress and the number of students per class is capped at a maximum of 6 students. Blu Swim School shall be entitled to assign or transfer a student to a different group, different class type and/or class on a different time slot, after considering the student’s age, swim levels and/or learning progress.
​
iv. If the regular instructor assigned is unable to conduct the class, Blu Swim School shall be entitled to assign a relief instructor to take over and conduct the class. Students are not permitted to choose instructors or to opt out of classes merely because the class is conducted by a relief instructor.
​
v. Blu Swim School reserves the right to cancel, postpone or reschedule all classes in the event of any unforeseen circumstances, the occurrence of any medical situations or contagious diseases and/or when a relief instructor is not available.
​
vi. Students must be punctual for their classes. No replacement classes will be given if students are late or refuse to enter the pool during their lessons.
​
vii. Temporary, occasional, or last-minute requests for change of student’s class time slot will not be entertained or permitted. If students wish to permanently change the time slot of their class, they may submit a written request to do so to Blu Swim School. However, Blu Swim School is not obligated to approve the request and shall have full discretion whether to approve or to reject the request.
​
viii. All students must wear proper swimming attire and maintain appropriate standards of hygiene.
​
B. Private 1-to-1 Classes (30 minutes per class) & Private Group Classes (45 minutes per class)
​
i. Private 1-to-1 Classes and Private Group Classes are on credit basis (4 lessons credit).
​
ii. Package Validity:
​iii. The purchase of packages for Private 1-to-1 Classes and Private Group Classes shall strictly be limited to students with age 4 and above only.
​
iv. The number of students for a Private 1-to-1 Class shall be limited to one (1) student only per class whilst a Private Group Class shall be capped at a maximum of four (4) students per class.
​
v. Lessons for Private Group Classes shall also be deemed to have been conducted and delivered even if one or more students of the class is absent and/or at least one student is present. Students in Private Group Classes can also choose to vary and/or replace students. For example, student A, B, C and D in a Private Group class can choose to replace student D to E if student D is unable to attend on a particular lesson.

vi. If the regular instructor assigned is unable to conduct the class, Blu Swim School shall be entitled to assign a relief instructor to take over and conduct the class. 6.0 Safety & Behaviour
​
6.1 Students must follow strictly all safety and security regulations stipulated by Blu Swim School.
​
6.2 Students must follow the instructions of their instructors. Students must not enter the pool except with the permission and under the supervision of their instructor.
​
6.3 Students must behave appropriately when attending classes.
​
6.4 Students behaving in a manner deemed disruptive and/or risky by Blu Swim School’s instructors will be asked to leave the class.
​
7.0 Medical Condition
​
7.1 Students with any form of medical condition affecting their ability to learn to swim and those suffering any contagious diseases or illnesses, must inform Blu Swim School of the said condition and if requested, must produce medical reports confirming that the student is unfit to swim.
​
7.2 Students who are sick and/or who are suffering from any form of contagious diseases or illnesses, must not attend classes and must declare and notify their condition to Blu Swim School or their instructors. Nonetheless, affected students must complete all their lessons within the validity of the package purchased.
​
7.3 Blu Swim School reserves the right to turn away any students on medical grounds.
​
​8.0 Changes and Updates
​
8.1 Blu Swim School reserves the right to alter, amend or update the terms and conditions stated herein at its sole discretion at any time without prior notice and all such alterations, amendments or updates shall be binding on you and/or your child. In the event of any disputes directly or indirectly arising from the terms and conditions stated herein, Blu Swim School’s decision shall be final and binding.

9.0 Governing Law
​
9.1 Malaysian laws shall govern this Agreement and its interpretation.
